McKinney-Vento Assistance Act
Under the federal McKinney-Vento Act, individuals living in the following situations may qualify for specific rights and protections:
- Residing in a shelter
- Staying in a motel or campground due to a lack of adequate alternative accommodations
- Living in a vehicle, park, abandoned building, or public transportation station
- Doubled up with others due to loss of housing or economic hardship
Eligible students are entitled to:
- Receive a free, appropriate public education
- Enroll in school immediately, even if they do not possess the documents typically required for enrollment
- Attend classes while the school collects necessary documentation
- Choose to enroll in the local school or continue attending their school of origin, based on their preference
- Receive transportation to and from the school of origin, if requested
- Access educational services comparable to those provided to other students, based on individual needs
If the school district determines that the selected school is not in the best interest of the student, it must provide a written explanation to the student and/or parent, along with information regarding the right to appeal the decision.
